Enrollment And Management Foreign Worker In Vietnam

On 25/3/2008 Government has issued a Decree No. 34/2008/NĐ-CP of regulate about enrollment and management foreign worker in Vietnam.

On 25/3/2008 Government has issued a Decree No. 34/2008/NĐ-CP of regulate about enrollment and management foreign worker in Vietnam. 

 

 

According to this, Government has a rule in enrollment and management foreign worker in Vietnam; sequences and procedures for granting work permits and the use of work permits; responsibilities of foreign worker, employer, and institutes in enrollment and management foreign worker in Vietnam.

Objects of this Decree are foreigners working in Vietnam and the businesses and organizations in Vietnam have used foreigner in working. 

Foreigners are working in Vietnam must qualified conditions: 18 years old or more; qualified health with work requirement; as a manager, operation director or specialist as described; with foreigners want to work in medicine practice, drug store or directly practice and treat or work in education, vocational training all must qualify the conditions of Vietnam Law about medicine practice, drug store, treatment, education, vocational training. No criminal history of violating national security; not being prosecuted for criminal responsibility; or being condemned to criminal punishment in accordance with the laws of Vietnam and foreign laws. They must have a work permit issued by the competent Institutes of Vietnam. 

About the sequence and procedure of enrollment foreign worker in Vietnam: Before recruitment at least 30 days, employers must notify the labor recruitment needs in the central or local newspapers (traditional newspapers, communications, radio station, electronic newspaper) about the content: the number of people recruitment, qualifications, salaries, working conditions and some other necessary requirement if the employer needs. In case of the employers through the recruitment of foreign-held job is not to inform recruitment needs on the central or local newspaper as prescribed above. The employer must provide adequate legal provisions of Vietnam-related rights and obligations of foreigners working in Vietnam, foreigners must thoroughly study the provisions of law Vietnam was provided by the employer, and prepare all necessary documents and comply with the provisions of this Decree. Foreigners wish to work in Vietnam must sent your CV to register for recruitment. The employers who receive registration documents for selection of foreign workers when records are full of papers under the regulations of this Decree and shall have procedures for granting work permits for foreigners to work in Vietnam under the regulations of this Decree. Upon being granted a work permit, foreigners and the employer must conduct the labor contract under the regulations of Vietnam's labor law. The content of labor contract is not inconsistent with the contents already stated in the work permit was granted.  

A Decree also specified documents and procedures for granting work permits, extension of work permits, re-granting of work permits; cases of work permits expired or invalid. Employers and individuals break Labour Law, depending on the seriousness of their violations to be administratively sanctioned or examined for personal liability in accordance with the laws of Vietnam.
